NOTICE

Notice is hereby given by the Council of the Borough of Riegelsville that a proposed ordinance #236 to vacate an unopened alley in the Borough of Riegelsville will be presented for review and passage at the Regular Council meeting to be held on Wednesday, April 12, 2017 at 7:00 p.m. at the Borough Hall, Riegelsville, Pennsylvania.  A full copy of the proposed ordinance may be examined without charge at the Borough Hall, the office of this newspaper or the Law Library at the Bucks County Court House during normal business hours, or may be obtained upon request for a charge not greater than the cost thereof.  The following is a summary of the proposed ordinance.  Section 1 states its purpose as vacating a certain unopened street in the Borough together with a legal description of it.  Section 2 identifies the owners of abutting property owners.  Section 3 states the basis and exercise of the Borough’s authority.  Section 4 is a severability section.  Section 5 is a repealer and amendment.  Section 6 states the effective date as being 30 days from passage.

ORDINANCE NO. 236

AN ORDINANCE OF THE BOROUGH OF

RIEGELSVILLE, BUCKS COUNTY, PENNSYLVANIA

VACATING AN UNOPENED ALLEY

BE IT ORDAINED by the Council of the Borough of Riegelsville as follows:

Section 1.        Purpose.

The purpose of this Ordinance is to vacate a certain unopened alley in the Borough of Riegelsville, the specific location, profile and dimensions of which are more fully set forth in the legal description attached hereto (“Unopened Alley”).

Section 2.        Names of Owners.

The names of all owners whose properties abut the unopened alley to be vacated are:

Section 3.        Basis and Exercise of Authority.

By and through the authority vested in it pursuant to section 1731 of the Borough Code, 8 Pa. C.S.A. § 1731, and after appropriate notice and public hearing held thereon, the Unopened Alley is hereby VACATED.

Section 4.        Severability.

If any section, clause or phrase of this Ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses and phrases of this Ordinance as an entirety, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity or any such section, sentence, clause or phrase.

Section 5.        Repealer and Amendment.

Upon enactment of this Ordinance, any and all provisions of all prior ordinances which are inconsistent herewith are specifically repealed and the Borough’s Code of Ordinances and Zoning Map is appropriately amended hereby.

Section 6.        Effective Date.

This Ordinance shall take effect and be in force thirty (30) days after its approval as required by law.
