Proposed Ordinance # 228

NOTICE

Notice is hereby given by the Council of the Borough of Riegelsville that proposed Riegelsville Borough Ordinance No. 228 entitled, “Ordinance Amending Chapter X of the code of Ordinances or Riegelsville Borough Amending Part I, Grass, Weeds and Other Vegetation,” will be presented for review and passage at the Regular Council meeting to be held on Wednesday, September 10, 2014 at 7:00 p.m. at the Borough Hall, 615 Easton Road, Riegelsville, Pennsylvania.  A full copy of the proposed ordinance may be examined without charge at the Borough Hall, the office of this newspaper or the Law Library at the Bucks County Court House during normal business hours, or may be obtained upon request for a charge not greater than the cost thereof.  The following is a summary of the Ordinance which will be presented for adoption at the meeting:

Section 1 is a repealer/amendment provision which provides that any and all prior ordinances inconsistent with the proposed ordinance are repealed and that section Chapter X of the Code of Ordinances is amended by adding a new Section 105 as follows:

Section 105.1 states the purpose of Section 105 as being to control the planning, growing or cultivating of noxious vegetation in Riegelsville Borough.

Section 105.2 defines “noxious vegetation” as used in Section 105.

Section 105.3 restricts certain classes of vegetation except as allowed in Sections 105.4 and 105.5.

Section 105.4 directs that any noxious vegetation on a property shall not be closer than ten (10) feet from any public right-of-way or property line.

Section 105.5 sets forth regulations governing the planting, growing or cultivation for running bamboo.

Section 105.6 provides for the procedure by complaints are received, notices are sent and corrective orders issued with respect to any violation of Section 105.

Section 105.7 is a penalty section which provides for court action in which a fine of $100.00/day for any continuing violation as well as the imposition of court costs and attorney’s fees.

Section 2 is a severability section.

Section 3 provides for an effective date to be determined by Council upon consideration.
