NOTICE<\/u><\/strong><\/p>\n

Notice is hereby given by the Council of the Borough of Riegelsville that a proposed ordinance #236 to vacate an unopened alley in the Borough of Riegelsville will be presented for review and passage at the Regular Council meeting to be held on Wednesday, April 12, 2017 at 7:00 p.m. at the Borough Hall, Riegelsville, Pennsylvania<\/strong>.\u00a0 A full copy of the proposed ordinance may be examined without charge at the Borough Hall, the office of this newspaper or the Law Library at the Bucks County Court House during normal business hours, or may be obtained upon request for a charge not greater than the cost thereof.\u00a0 The following is a summary of the proposed ordinance.\u00a0 Section 1 states its purpose as vacating a certain unopened street in the Borough together with a legal description of it.\u00a0 Section 2 identifies the owners of abutting property owners.\u00a0 Section 3 states the basis and exercise of the Borough\u2019s authority.\u00a0 Section 4 is a severability section.\u00a0 Section 5 is a repealer and amendment.\u00a0 Section 6 states the effective date as being 30 days from passage.<\/p>\n

AN ORDINANCE OF THE BOROUGH OF<\/strong><\/p>\n

RIEGELSVILLE, BUCKS COUNTY, PENNSYLVANIA<\/strong><\/p>\n

VACATING AN UNOPENED ALLEY<\/u><\/strong><\/p>\n

BE IT ORDAINED <\/strong>by the Council of the Borough of Riegelsville as follows:<\/p>\n

Section 1.<\/u>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Purpose.<\/p>\n

The purpose of this Ordinance is to vacate a certain unopened alley in the Borough of Riegelsville, the specific location, profile and dimensions of which are more fully set forth in the legal description attached hereto (\u201cUnopened Alley\u201d).<\/p>\n

Section 2.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Names of Owners.<\/p>\n

Section 3.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Basis and Exercise of Authority.<\/p>\n

By and through the authority vested in it pursuant to section 1731 of the Borough Code, 8 Pa. C.S.A. \u00a7 1731, and after appropriate notice and public hearing held thereon, the Unopened Alley is hereby VACATED.<\/p>\n

Section 4.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Severability.<\/p>\n

If any section, clause or phrase of this Ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses and phrases of this Ordinance as an entirety, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity or any such section, sentence, clause or phrase.<\/p>\n

Section 5.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Repealer and Amendment.<\/p>\n

Upon enactment of this Ordinance, any and all provisions of all prior ordinances which are inconsistent herewith are specifically repealed and the Borough\u2019s Code of Ordinances and Zoning Map is appropriately amended hereby.<\/p>\n

Section 6.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Effective Date.<\/p>\n

This Ordinance shall take effect and be in force thirty (30) days after its approval as required by law.<\/p>\n
