{"id":476,"date":"2013-02-27T13:10:40","date_gmt":"2013-02-27T18:10:40","guid":{"rendered":"https:\/\/riegelsville.org\/?p=476"},"modified":"2013-02-27T13:10:40","modified_gmt":"2013-02-27T18:10:40","slug":"proposed-ordinance-224","status":"publish","type":"post","link":"https:\/\/riegelsville.org\/?p=476","title":{"rendered":"Proposed Ordinance 224"},"content":{"rendered":"<p align=\"center\"><strong>RIEGELSVILLE BOROUGH ORDINANCE NO. 224<\/strong><\/p>\n<p><strong>\u00a0<\/strong><strong>AN ORDINANCE VACATING A CERTAIN UNOPENED CUL-DE-SAC<\/strong><\/p>\n<p align=\"center\"><strong><span style=\"text-decoration: underline;\">AT THE TERMINUS OF POPLAR ROAD, RIEGELSVILLE, PENNSYLVANIA<\/span><\/strong><\/p>\n<p style=\"text-align: center;\"><strong>\u00a0<\/strong><strong>Article I \u2013 Title and Purpose<\/strong><\/p>\n<p><strong>\u00a0<\/strong>This Ordinance shall be known as \u201cAn Ordinance Vacating a Certain Unopened Cul-De-Sac at the Terminus of Poplar Road, Riegelsville, Pennsylvania.\u201d\u00a0 The purpose of the Ordinance is to vacate that the 60\u2019 radial cul-de-sac located at the terminus of Poplar Road as first laid out and shown on a subdivision plan entitled, \u201cSubdivision Plans Prepared for Joseph Cowley\u201d as filed in the Bucks County Recorder\u2019s Office on February 2, 2000 in Plan Book 299, Page 200 and subsequently depicted in a plan entitled \u201cPreliminary\/Final Subdivision Plans Prepared for Quaint Oak Bank\u201d as filed in the Bucks County Recorder\u2019s Office in Plan Book 376, Page 2.<\/p>\n<p style=\"text-align: center;\">\u00a0<strong>Article II \u2013 Abutting Property Owners<\/strong><\/p>\n<p align=\"center\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The names of the affected abutting property owners, all of whom joined in the Petition by which this matter was brought before the Riegelsville Borough Council, are James G. Sweeney, Eileen A. Sweeney and Gayle M. Cillo.<\/p>\n<p style=\"text-align: center;\"><strong>\u00a0<\/strong><strong>Article III &#8211; Text<\/strong><\/p>\n<p><strong>\u00a0<\/strong><strong>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 AND NOW, <\/strong>upon consideration of the Petition of James G. Sweeney, Eileen A. Sweeney and Gayle M. Cillo and after duly notice hearing held thereon, it is hereby <strong>ORDAINED<\/strong>, under and pursuant to the authority granted the Borough Council by sections 46371 and 46732 of the Borough Code, 53 P.S. \u00a7 46371 and 46372, that the Petition is <strong>GRANTED<\/strong> and that the said certain, unopened 60\u2019 radial cul-de-sac located at the terminus of Poplar Road as first laid out and shown on a subdivision plan entitled, \u201cSubdivision Plans Prepared for Joseph Cowley\u201d as filed in the Bucks County Recorder\u2019s Office on February 2, 2000 in Plan Book 299, Page 200 and subsequently depicted in a plan entitled \u201cPreliminary\/Final Subdivision Plans Prepared for Quaint Oak Bank\u201d as filed in the Bucks County Recorder\u2019s Office in Plan Book 376, Page 2 is hereby <strong>VACATED. <\/strong><\/p>\n<p style=\"text-align: center;\"><strong>\u00a0<\/strong><strong>Article IV \u2013 Recording<\/strong><\/p>\n<p align=\"center\"><strong>\u00a0<\/strong>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 This Ordinance shall be duly recorded in the Office of the Recorder of Deeds of Bucks County, Pennsylvania.<\/p>\n<p style=\"text-align: center;\"><strong>\u00a0<\/strong><strong>Article V \u2013 Repealer<\/strong><\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 All provisions of the Riegelsville Borough Code unaffected by this Ordinance are hereby declared to be in full force and effect and any provisions of the Riegelsville Borough Code inconsistent with the terms of this Ordinance are hereby repealed to the extent of the inconsistency.<\/p>\n<p style=\"text-align: center;\"><strong>\u00a0<\/strong><strong>Article VI \u2013 Severability<\/strong><\/p>\n<p><strong>\u00a0<\/strong>The provisions of this Ordinance are declared to be severable.\u00a0 If any section, clause or phrase of this Ordinance is declared by a court of competent jurisdiction to be invalid or unconstitutional, such determination shall have no effect on the remaining provisions of this Ordinance.<\/p>\n<p style=\"text-align: center;\"><strong>\u00a0<\/strong><strong>Article VII \u2013 Effective Date<\/strong><\/p>\n<p><strong>\u00a0<\/strong>This Ordinance shall become effective upon the date of its adoption and is incorporated by reference into the Borough\u2019s Code of Ordinances with the same force and effect as if duly recorded therein.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 ENACTED AND ORDAINED THIS\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00a0\u00a0 DAY OF MARCH 2013.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>ATTEST:\u00a0<\/p>\n<p>Secretary\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>RIEGELSVILLE BOROUGH\u00a0\u00a0COUNCIL\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>:\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>By:\u00a0\u00a0\u00a0\u00a0\u00a0 _________________________<span style=\"text-decoration: underline;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Thomas E.
